Tod\u0117l ypatingai tarptautini\u0173 krovini\u0173 perve\u017eim\u0173 sritis, reikalauja tam tikr\u0173 taisykli\u0173 unifikavimo tarptautiniu mastu. Viena i\u0161 svarbiausi\u0173 ir pla\u010diausiai naudojam\u0173 \u0161iuo tikslu pasira\u0161yt\u0173 sutar\u010di\u0173 \u2013\u00a0 Tarptautinio krovini\u0173 ve\u017eimo keliais sutarties konvencija CMR (toliau \u2013 CMR konvencija), kurios susitarian\u010di\u0173 \u0161ali\u0173 pagrindinis tikslas \u2013 suvienodinti tarptautinio krovini\u0173 ve\u017eimo sutarties s\u0105lygas, t.y. tokiems ve\u017eimams reikalingus dokumentus ir ve\u017e\u0117jo atsakomyb\u0119.<\/p>\n<p>Norint pasiekti teisin\u012f apibr\u0117\u017etum\u0105, CMR konvencija tur\u0117t\u0173 b\u016bti taikoma savaranki\u0161kai, kad visos konvencijos nar\u0117s \u017einot\u0173 kokio rezultato galima tik\u0117tis teisme, nepaisant to kurios valstyb\u0117s nacionaliniame teisme b\u016bt\u0173 nagrin\u0117jama byla. Ta\u010diau tai lieka tik teorija. Problema \u0161iuo klausimu yra tai, kuomet skirting\u0173 valstybi\u0173 teismai, skirtingai vertina ir nustato ty\u010dinius ve\u017e\u0117jo veiksmus, nes u\u017esienio valstybi\u0173 teis\u0117 kalt\u0117s formoms suteikia skirting\u0105 turin\u012f ir prasm\u0119.<\/p>\n<p>Atrodyt\u0173, jog CMR konvencija tarptautiniu mastu suvienodino krovini\u0173 ve\u017eimo sutarties nari\u0173 atsakomyb\u0119, ta\u010diau jos taikymas ir ai\u0161kinimas buvo paliktas susitarian\u010di\u0173 \u0161ali\u0173 nacionaliniams teismams, kas l\u0117m\u0117 skirting\u0105 CMR konvencijos interpretacij\u0105 ir rezultatus teism\u0173 praktikoje.<\/p>\n<p>Viena i\u0161 toki\u0173 skirtingai interpretuojam\u0173 nuostat\u0173 \u2013 CMR konvencijos 29 straipsnio 1 dalies nuostata, nustatanti, jog krovini\u0173 ve\u017e\u0117jo civilin\u0117 atsakomyb\u0117 n\u0117ra ribojama, atsi\u017evelgiant \u012f jo kalt\u0117s form\u0105.<\/p>\n<p>Krovini\u0173 perve\u017eim\u0173 srityje yra \u012fprasta, jog ve\u017e\u0117jo civilin\u0117 atsakomyb\u0117, praradus dal\u012f arba vis\u0105 krovin\u012f, ribojama ir n\u0117ra taikomas visi\u0161ko nuostoli\u0173 atlyginimo principas. Ta\u010diau CMR Konvencijos 29 straipsnyje \u012ftvirtinta i\u0161imtis, kuri numato, jog ve\u017e\u0117jas negali vadovautis \u0161ios Konvencijos nuostatomis, kurios j\u012f atleist\u0173 nuo atsakomyb\u0117s ar j\u0105 ribot\u0173, jeigu \u017eala buvo padaryta s\u0105moningai arba d\u0117l jo kalt\u0117s, kuri pagal \u012fstatymus, taikomus \u0161i\u0105 byl\u0105 nagrin\u0117jan\u010dio teismo, prilyginama ty\u010diniams veiksmams.<\/p>\n<p>CMR konvencija buvo pasira\u0161yta angl\u0173 ir pranc\u016bz\u0173 kalbomis, abiem tekstams turint vienod\u0105 gali\u0105. Neribotai krovini\u0173 ve\u017e\u0117jo civilinei atsakomybei nustatyti buvo \u012ftvirtintos kalt\u0117s formos <em>wilful misconduct<\/em> (angl\u0173 kalboje) ir <em>dol <\/em>(pranc\u016bz\u0173 kalboje), kurios \u012f lietuvi\u0173 kalb\u0105 i\u0161verstos, kaip s\u0105moningi veiksmai (ty\u010diniai veiksmai).<\/p>\n<p>CMR konvencija buvo rengiama 1929 m. Var\u0161uvos konvencijos, kuri nustat\u0117 ve\u017e\u0117jo oru taisykles, pagrindus. Ta\u010diau jau pasira\u0161ant CMR konvencij\u0105, Var\u0161uvos konvencija buvo pakeista 1955 m. Hagos Protokolu. Hagos protokolu Var\u0161uvos konvencijos straipsnis \u012ftvirtinantis neribot\u0105 ve\u017e\u0117jo atsakomyb\u0117 buvo pakeistas ty\u010dinio ve\u017e\u0117jo veiksmo sampratos formuluote \u012ftvirtinan\u010dia subjektyv\u0173j\u012f element\u0105, kuri nustat\u0117, jog civilin\u0117 atsakomyb\u0117 nebus ribojama, jei veiksmai atlikti: \u201eaplaid\u017eiai, bet suvokiant, kad d\u0117l to gali b\u016bti padaryta \u017eala\u201c <em>(ang. recklessly and with knowledge that damage would probably result).<\/em><\/p>\n<p>Galima pasteb\u0117ti, jog Var\u0161uvos konvencijos straipsnis, neribojantis ve\u017e\u0117jo civilin\u0117s atsakomyb\u0117s, atsi\u017evelgiant \u012f ve\u017e\u0117jo kalt\u0117s form\u0105, kuriuo buvo formuojama ir CMR konvencija, buvo pakeistas nauju sampratos formavimu, atsi\u017evelgian\u010diu \u012f subjektyvi\u0105j\u0105 ve\u017e\u0117jo kalt\u0117s pus\u0119 ir \u012ftvirtinantis neapdairumo kalt\u0117s form\u0105 kartu su subjektyviomis \u017einiomis. D\u0117l to CMR konvencijos 29 straipsnio nuostata i\u0161 karto buvo kritikuojama, nes ji per\u0117m\u0117 po\u017ei\u016br\u012f, kuriuo ve\u017e\u0117jo kalt\u0117 buvo nustatoma objektyviomis aplinkyb\u0117mis, ir kuris jau buvo suk\u0117l\u0119s daug problem\u0173 bandant unifikuoti transporto teisin\u012f reguliavim\u0105.<\/p>\n<p>Taip pat, dar CMR konvencijos pri\u0117mimo etape buvo si\u016bloma, jog s\u0105voka <em>\u201ekalt\u0117, prilyginama ty\u010diniams veiksmams\u201c<\/em> b\u016bt\u0173 pakeista \u012f <em>\u201edidelis neatsargumas\u201c<\/em> (ang. gross negligence), ta\u010diau \u0161is si\u016blymas buvo atmestas, nes bendrosios teis\u0117s sistemoje n\u0117ra \u012ftvirtintos tokios s\u0105vokos ir ne visos nacionalin\u0117s teis\u0117s sistemos skiria skirtingus neatsargumo laipsnius. Tai leid\u017eia teigti, kad patys CMR konvencijos reng\u0117jai nenor\u0117jo, kad ve\u017e\u0117jai netekt\u0173 savo ribotos atsakomyb\u0117s d\u0117l didelio neatsargumo.<\/p>\n<p>Pastaruoju metu, Lietuvos teism\u0173 praktikoje, jau laikomasi vieningos pozicijos, kad vien pa\u017eeidimo faktas, pats savaime nerodo didelio neatsargumo, jeigu n\u0117ra pagrindo konstatuoti s\u0105moningo netinkamo krovini\u0173 ve\u017e\u0117jo elgesio. Tod\u0117l neribota krovini\u0173 ve\u017e\u0117jo civilin\u0117 atsakomyb\u0117 tampa labiau i\u0161imtimi nei taisykle.<\/p>\n<p>Ta\u010diau atlikus ir u\u017esienio teism\u0173 praktikos ap\u017evalg\u0105, taikant CMR konvencijos 29 straipsnio nuostat\u0105, neribojan\u010di\u0105 krovini\u0173 ve\u017e\u0117jo civilin\u0117s atsakomyb\u0117s, galime pasteb\u0117ti, jog CMR konvencijos tikslas \u2013 suvienodinti krovini\u0173 ve\u017e\u0117jo civilin\u0117 atsakomyb\u0117, ir tuo pa\u010diu neribotos civilin\u0117s atsakomyb\u0117s s\u0105lygas \u2013 n\u0117ra pasiektas.<\/p>\n<p>CMR 29 str. nuostatas b\u016bt\u0173 galima i\u0161skirti \u012f tris jurisdikcijas:<\/p>\n<p>1) kurios didel\u012f neatsargum\u0105 prilygina ty\u010diai (pvz. Belgija, Pranc\u016bzija, Ispanija, Italija ir Portugalija);<\/p>\n<p>2) kurios ty\u010diai prilygin\u0105 neapdairum\u0105, \u017einant, kad \u017eala grei\u010diausiai bus padaryta (pvz. Vokietija, Nyderlandai);<\/p>\n<p>3) neturi jokios kalt\u0117s formos, prilyginamos ty\u010diai, ir \u0161i\u0105 nuostat\u0105 vertina tik ty\u010dios kontekste (pvz. Jungtin\u0117 Karalyst\u0117, Graikija).<\/p>\n<p>Ta\u010diau nepaisant skirting\u0173 jurisdikcij\u0173, did\u017eiojoje dalyje CMR konvencijos, \u012fskaitant ir Lietuvos, nari\u0173 teism\u0173 praktikoje, taikant neribot\u0105 krovini\u0173 ve\u017e\u0117jo civilin\u0119 atsakomyb\u0119, yra privalomas subjektyvusis kriterijus, t.y. asmens suvokimas ir s\u0105moningas neteis\u0117t\u0173 veiksm\u0173, galimai sukelsian\u010di\u0173 \u017eal\u0105, siekimas.<\/p>\n<p>Apibendrinat, kas i\u0161d\u0117styta, ty\u010diniai krovini\u0173 ve\u017e\u0117jo veiksmai <em>(ang. wilful misconduct)<\/em> tur\u0117t\u0173 b\u016bti prilyginami neapdairumui (ang. recklessness) kartu su subjektyviomis \u017einiomis galim\u0173 pasekmi\u0173. Lietuvos teis\u0117s doktrinoje tai gal\u0117t\u0173 b\u016bti prilyginama netiesioginei ty\u010diai. Teism\u0173 praktikoje formuojam\u0105 samprat\u0105, jog <em>\u201eneatsargumas prilyginamas ty\u010diai\u201c<\/em> reik\u0117t\u0173 tikslinti nustatant, kad \u201e<em>ty\u010diai prilyginamas neapdairumas (neatsargumas), \u017einant, kad d\u0117l to gali b\u016bti padaryta \u017eala\u201c<\/em>, kadangi netiesiogin\u0117 ty\u010dia yra apimama ty\u010dini\u0173 veiksm\u0173 s\u0105vokos.
